A Determination of Heirship is simply an action filed by a relative or friend on behalf of a deceased person who has failed to leave a Will or Living Trust identifying heirs to the estate.
When there isn’t a possibility of locating a Will (holographic or attorney drafted) the Determination of Heirship is filed separately in Probate Court and separate of the petition for Administration. Unlike an Affidavit of Heirship, the Determination of Heirship must be dealt with through the Court system.
